These terms and conditions of sale are entered into between, on the one hand, SAS Hômaly — a company with a share capital of €500, headquartered at 25 rue Saint Médard, 51490 Pontfaverger-Moronvilliers, France, registered with the Reims Trade and Companies Register under number 897 661 997 (hereinafter referred to as “Hômaly”) and operator of the Agence Placid de Reims website (https://reims.agences-placid.com) — and, on the other hand, any natural or legal person wishing to make a purchase via the Agence Placid de Reims website (hereinafter referred to as “the Buyer”).

Article 1. Purpose

These terms and conditions of sale define the contractual relationship between SAS Hômaly and the Buyer, as well as the conditions applicable to any purchase made through the Hômaly website (https://reims.agences-placid.com). Purchasing a product via this site implies the Buyer’s unreserved acceptance of these terms and conditions of sale, which the Buyer acknowledges having read prior to placing an order. Before any transaction, the Buyer declares that the purchase of products on the Hômaly website is unrelated to their professional activity and is limited to strictly personal use, and that they possess the full legal capacity to enter into a binding agreement under these general terms and conditions of sale.

Hômaly reserves the right to modify these terms and conditions of sale at any time in order to comply with new regulations or to improve the use of its website. Consequently, the applicable terms and conditions will be those in effect on the date the Buyer places the order.

Article 2. Products

The products offered are those listed on the Hômaly website (https://reims.agences-placid.com), subject to stock availability. Hômaly reserves the right to modify its product assortment at any time. Each product is presented on the website with a description outlining its main features. Photographs are as accurate as possible but are not contractually binding on the seller. Sales of products featured on the site are open to buyers residing in countries that fully authorise the entry of these products into their territory.

Article 3. Prices

Prices listed on the online catalogue’s product pages are in Euros (€), inclusive of all taxes (VAT included), reflecting the VAT rate applicable on the day of the order. Any change in the VAT rate may be passed on to the product prices. Hômaly reserves the right to modify its prices at any time; however, the price listed in the catalogue on the day of the order is the only one applicable to the Buyer. Listed prices do not include delivery charges, which are billed in addition to the cost of the purchased products, based on weight and destination country.

Article 4. Ordering and Payment Terms

Buyers are not required to create an account on the site. However, they will be asked to provide an email address and personal details (name, address) for order tracking and invoicing purposes.

Hômaly reserves the right to cancel an order or a specific product if it is unable to fulfil the request (e.g. due to stock shortages or operational issues). In the event of cancellation, Hômaly will refund 100% of the cost of the cancelled products, credited back to the bank card used for the original payment.

Secure payment by bank card (via CB and PayPal)

The Buyer selects the products they wish to order in their “shopping cart,” makes any necessary adjustments (quantities, product references, etc.), and verifies the delivery address or enters a new one. Shipping costs are then calculated and presented to the Buyer. The Buyer is then prompted to review all information, read and accept these General Terms and Conditions of Sale by checking the appropriate box, and confirm the order by clicking the “Confirm my order” button. Finally, the Buyer is redirected to the secure payment interface to securely enter their bank card details (CB, VISA, MASTERCARD). If the payment is accepted, the order is recorded and the contract is definitively concluded. Payment by bank card is irrevocable. In the event of fraudulent use of the card, the Buyer may request cancellation of the card payment; the amounts paid will then be re-credited or refunded. The cardholder shall not be held liable if it is proven that the disputed payment was made fraudulently and remotely, without physical use of the card. To obtain a refund for the fraudulent charge and any associated bank fees incurred, the cardholder must contest the transaction in writing with their bank within 70 days of the transaction, or up to 120 days if their contract with the bank so provides. Amounts debited are refunded by the bank within a maximum of one month upon receipt of the written dispute filed by the cardholder. No restitution fees may be charged to the cardholder.

Confirmation of an order constitutes acceptance of these terms and conditions of sale, acknowledgement of full awareness thereof, and waiver of any right to rely on the Buyer’s own purchasing conditions. All data provided and the recorded confirmation shall constitute proof of the transaction. If the Buyer has provided an email address on their order form, Hômaly will send them an email confirming that their order has been recorded.

International credit and/or payment card issuers or banks will set the exchange rate applicable to your purchase and may charge processing or handling fees related to the payment, which you will be required to settle if using an international credit card.

Article 5. Retention of Title

Hômaly retains full and complete ownership of the products sold until payment has been received in full, including principal, charges, and taxes.

Article 6. Right of Withdrawal

Pursuant to Article L121-20 of the French Consumer Code, the Buyer has fourteen working days from the date of delivery of their order to exercise their right of withdrawal and request a refund without penalty. However, if the withdrawal occurs after the check-in date, no refund can be issued as the order will have already been fulfilled.

In accordance with Article 2 of Decree No. 2022-424 of 25 March 2022, these provisions came into force on 28 May 2022.

Article 7. Liability

In the context of distance selling, Hômaly is bound only by an obligation of means. Its liability may not be engaged for any damage resulting from the use of the Internet, such as data loss, intrusion, viruses, service interruption, or other unintentional issues.

Article 8. Intellectual Property

All elements of the website https://reims.agences-placid.com are and remain the exclusive intellectual property of Hômaly. No one is authorised to reproduce, exploit, or use in any capacity whatsoever, even partially, any elements of the site, whether in the form of photographs, logos, visuals, or text.

Article 9. Personal Data Protection

In accordance with Regulation (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, Hômaly implements a personal data processing system for the purpose of selling and delivering the products and services defined in this contract.

These distance selling terms and conditions are governed by French law. For any disputes or litigation, the competent court shall be the Commercial Court of Reims.
